
The Government has agreed to revise the most controversial Bill of this time, The Advocate (Amendment) Bill, 2025. A letter by the Chief Controller of Accounts has expressed that a fresh, revised draft will be prepared. The letter was addressed to Shri Manan Kumar Mishra, Chairman, Bar Council of India. As per the letter the Advocate (Amendment) Bill, 2025 was made available for public consultation on 13 February 2025. The last date for making comments and suggestions on the draft was 28.02.2025 but the same has been closed on 22.02.2025. A lot of suggestions they received and they will present a fresh draft soon for consultation with stakeholders.
The proposed Bill was enacted to ensure the effective regulation of the legal profession and to amend the provisions of the Advocates Act, 1961, with the aim of modernizing the administration of legal education and the legal profession in India. These amendments seek to address the evolving needs of the legal landscape, promote ethical practices, and enhance the transparency and accountability of the legal community. By streamlining procedures and introducing necessary reforms, the amendments will better equip legal professionals to meet contemporary challenges.
There is satisfaction amongst the peacefully protesting Advocates across the country. As per the protesters, the proposed Bill was arbitrary, and also violative of the basic rights of the Advocates. Almost all the Bar Associations have released the date for their protest. The proposed Bill placed the Bar Council of India at dominant position over the State Bar Councils. Various powers of the State Bar Councils were abolished. Also, the Central Government was somehow all in all, indirectly.
