Who is an Advocate-
An Advocate is a person who is recognized/authorized by the Law to argue for the cause/issue of another person, especially before a Court of Law. Any person who has passed LL.B. (Legum Baccalaureus) can fill out the Advocate Registration Form and submit that, to the concerned State Bar Council. When the name of that person is written in its roll by any State Bar Council thereafter he becomes an Advocate registered with the concerned State Bar Council
Salary/Income of an Advocate-
Advocacy is a profession in which there is no particular fixed scale of income. The income of Advocates ranges from ₹0/- to Crores of ₹/ Day. Now you would be thinking what nonsense you are being told about, how can it be possible? Why will someone work for no money, what is the benefit of that work that doesn’t pay off? Now we will understand this variation in the income of Advocates under the following heads and also, why this is. –
Income of Designated Senior Advocates’ –
Section 16 of the Advocate Act, 1961 creates a class of Advocates as Senior Advocates. As per the provisions of this section, An advocate may, with his consent, be designated as Senior Advocate if the Supreme Court or a High Court believes that under his ability, standing at the Bar or special knowledge or experience in law, he is deserving of such distinction. Senior advocates shall, in the matter of their practice, be subject to such restrictions as the Bar Council of India may, in the interests of the legal profession, prescribe.
Now when it comes to the income point of view then it would not be wrong to put them in the most elite class of Advocate in terms of money. Although, there is no such distinction anywhere but here just to make this point very clear this is being used. The Senior Advocates charge ₹1,00,000 (One Lac)- to ₹20,00,000 (Twenty Lac) per hearing. If we have to simplify it in terms of money, if we consider an average of ₹ 10 Lac/ hearing then if there are 10 cases per day their daily average income of one working day is around 1 Crore₹. It means around 1 Cr. ₹ per working day,
In addition to this, they charge around 10-20% of their fee for clerk and 15-25% of their fee for their junior. However, all Senior Advocates do not charge the same. It is also very necessary to know that people give this huge amount in fee just for their hard work, knowledge, capability and image before the court.
Their consultation fee is also very high. Any designated Senior Advocate would charge around ₹50,000 for 15-30 Minutes or more for giving consultation.
Income of other Senior Advocates-
Senior Advocates are those Advocates who are described under Section 16 of the Advocate Act, 1961. Apart from this, there is no legal provision or concept of a Senior Advocate. Advocates at the District level and Sub-district level are also called as Senior Advocates considering their experience and the long time of their practice. The income of these Advocates also depends upon their area of practice (Civil, Criminal etc.), locality, experience, knowledge, etc. Their average monthly income may range from at least ₹50,000/- to lakhs of ₹ per month.
Salary/Income of Junior Advocates-
Junior Advocates are those Advocates who have very little practical experience before a court of law. These are the least-paid Advocates. Every Advocate journey starts with as a Junior Advocate under a Senior Advocate. Juniors imply that the Advocate is in the learning phase. But it is not like that they are any more less capable. In many cases, it is been seen that they are prepared much more in any case than a Senior Advocate. The thing they lack is a number of cases, resources like subscriptions to top legal journals, rulings and money.
In the initial one to two years of practice, they are initially either not paid by their Senior Advocate or paid ₹ 10-15,000/ Month for which they have to give a daily average of 12-15 hours for Senior Advocate with him in the Court and his Chamber. After two years of practice, big chambers give a hike and for this, there is no upper limit. Few big chambers are paying ₹ 4-5 Lac per month to the experienced Junior Advocates but it’s not easy to get into those Chambers.
After two to three years of practice, Junior Advocates also start getting their cases which they deal with their Senior’s help. Although they do not get very much fee as like their seniors. So, by and by Juniors also start making money. By the time they are no longer Junior Advocates. They are replaced by someone and also replaces somebody.
Salary/Income of Government Advocates-
Government Advocates are those Advocates which presents the side of the Government in any case/issue before the court of law/tribunal. They are recruited by the Government through Examination and also appointed by the concerned Government or authority to present their side before the court. Here, concerned Government is meant by Central Government or State Government or Local Self Government as the case may be.
The average income of a Government Advocate at the District level is around ₹40-50,000/ Month. The monthly average income of a Government Advocate in the High Court or Supreme Court is between 1-2 Lac ₹/ Month. In addition to this monthly income, they are also paid NPA(Non-practice allowance) which is different for different Governments and departments to which the Advocate has been attached.
